Terms and Conditions

Welcome to Stroke of Love’s Terms and Conditions (these “Terms”). This is a contract between you and Stroke of Love, Inc. (“Stroke of Love,” “we,” or “us”). Please read these Terms carefully before using the Stroke of Love website or mobile application (“Stroke of Love” or the “App”).

1. Accounts and Registration: To use Stroke of Love, you must register for an account (“Account”). To create an Account, you must:
   • Be at least 18 years old
   • Be legally permitted to use Stroke of Love in your home country
   You can create an Account through our website or by using your Facebook login. If using Facebook, you authorize us to access certain information like photos and friend lists. Do not share your Account credentials or access Stroke of Love through another user’s Account. We may monitor for underage use and request age verification. You can delete your Account from the Settings page. However, it may take time for all of Your Content (defined below) to be fully removed.
2. Types of Content: There are three types of content on Stroke of Love: Your Content: Any content you upload or submit, like photos, videos, text, etc. User Content: Content provided by other Stroke of Love users. Stroke of Love Content: All other text, graphics, trademarks, software, and other content provided by Stroke of Love. Your Content must comply with our Community Guidelines. By uploading Your Content, you grant Stroke of Love a perpetual, worldwide, royalty-free license to use, copy, modify, and distribute Your Content in any way. However, you retain ownership of Your Content. You may only use other users’ content as permitted by Stroke of Love to facilitate connections. Do not use it for commercial purposes, harassment, or illegal activities. Stroke of Love Content belongs solely to us and our licensors. We grant you a limited, revocable license to access and use Stroke of Love Content through the App.
3. Prohibited Content and Conduct: You agree not to upload, post, or transmit any content that:
   • Is illegal, threatening, defamatory, infringing, or invasive of privacy
   • Is harmful to minors
   • Contains explicit/unconsented images
   • Is abusive, hateful, discriminatory, obscene, or violent
   • Involves commercial activities, spam, fraud, or impersonation
   • Contains malware or malicious code
   We reserve the right to remove any prohibited content and take other actions like issuing warnings, suspending accounts, and cooperating with law enforcement. Do not misuse or interfere with Stroke of Love, violate these Terms or policies, or assist others in doing so.
4. Services and Paid Subscriptions: Stroke of Love may offer premium services and subscriptions. If you purchase a subscription, it will automatically renew at our then-current price unless you cancel first. To cancel a Stroke of Love subscription, use your account settings. For third-party payments like app stores, cancel through that platform. Purchases are generally non-refundable, but certain users in some regions may be eligible for refunds during a short cancellation window per applicable laws.
5. Rules and Prohibited Conduct: Do not misuse Stroke of Love or act unlawfully. Specific violations include:
   • Spam, harassment, hate speech, impersonation
   • Infringing intellectual property rights
   • Interfering with Stroke of Love’s operations
   • Scraping, copying, or reverse engineering Stroke of Love
   We may investigate any potential violations using techniques like searching public records. We reserve rights to terminate accounts, preserve data, and cooperate with law enforcement. Use Stroke of Love advisedly. We facilitate connections, but cannot guarantee user legitimacy or conduct. You are solely responsible for your interactions.
6. Disclaimers and Limitations:
   Stroke of Love’s services are provided “as is” without warranties of any kind. We disclaim all warranties, including for fitness for a purpose or non-infringement, to the fullest extent permitted by law. Stroke of Love is not liable for any damages from using our services, content, or users’ conduct. This includes direct, indirect, incidental, consequential, and punitive damages. These limitations apply to the fullest extent allowed, but some jurisdictions may restrict disclaimer of implied warranties or liability for damages.
7. Indemnity: You will indemnify, defend, and hold Stroke of Love harmless from any claims arising from your misconduct, violations of these Terms, or unlawful use of Stroke of Love.
8. Third-Party Services: Stroke of Love may integrate third-party services with their own terms you must follow, like terms from Snap for using its augmented reality features.
9. Termination and Account: Deletion You can delete your Account through your Settings. However, prepaid services are generally non-refundable upon termination. We reserve the right to terminate your access or delete your Account for violations, improper conduct (on or off Stroke of Love), or any reason we deem appropriate. We have sole discretion but may provide notice first. Termination does not relieve you of obligations like paying fees, nor restrict our rights like indemnification.
10. Dispute Resolution and Arbitration: Please read this section carefully as it requires you to arbitrate most disputes with Stroke of Love. You can opt out of arbitration by emailing optout@strokeoflove.com within 30 days of creating your Account. This Arbitration Agreement covers any disputes arising from your relationship with Stroke of Love, except for limited exceptions like intellectual property claims. Before filing an arbitration claim, you agree to first notify Stroke of Love and attempt to informally resolve the dispute for 60 days. Arbitrations will be conducted on an individual, non-class basis under the rules specified here. The arbitrator’s decision is final except for limited court review. An arbitrator can award the same relief as a court. This Arbitration Agreement survives after your relationship with Stroke of Love ends. Opting out of arbitration means all other Terms still apply. Submitting arbitration demands without following opt-out instructions means you accept arbitration. 11. General Provisions:
    These Terms and incorporated policies constitute the entire agreement and supersede any prior agreements. We may prospectively modify these Terms by posting revisions, which are effective upon posting for new and continued use of Stroke of Love. These Terms are governed by the laws of Texas, except as required by your local laws. Any claims must be resolved in Travis County, Texas unless delegated to arbitration under Section 10. “Stroke of Love” means Stroke of Love, Inc. and its affiliates operating Stroke of Love.
